These Terms of Service ("Terms") govern your access to and use of the Worqbook website (worqbook.com), mobile applications, and all related services (collectively, the "Service") operated by Tech Udyam Solutions Private Limited ("Company," "we," "us," or "our"), a company registered in India.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

Worqbook is an AI-powered educational platform that enables users to generate personalized practice workbooks and worksheets. Our Service includes:

• Workbook Generation: AI-powered creation of customized educational workbooks across various subjects and difficulty levels
• Digital Downloads: Downloadable PDF workbooks for personal or educational use
• Free Tools: Access to free educational tools like word scramble generator, vocabulary maker, and math problem generator
• Account Features: Save, manage, and organize your generated workbooks

3. User Accounts

3.1 Account Registration

To access certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

3.2 Account Security

You are responsible for safeguarding your password and for any activities or actions under your account. We encourage you to use a strong, unique password and enable any additional security features available. We will not be liable for any loss or damage arising from your failure to comply with this security obligation.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms, fraudulent activity, or non-payment. You may also delete your account at any time through your account settings or by contacting us.

4. Intellectual Property Rights

4.1 Worqbook Platform

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Tech Udyam Solutions Private Limited. The Service is protected by copyright, trademark, and other laws of India and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

4.2 User-Generated Content

You retain ownership of any content you input into our Service (such as custom text, preferences, and parameters). By using our Service, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store this content solely for the purpose of providing the Service to you.

4.3 Generated Workbooks

Upon purchase or download of a workbook generated through our Service, you are granted a non-exclusive, non-transferable license to use the workbook for personal or educational purposes. This license permits you to:

• Print and use the workbook for personal learning or teaching
• Share printed copies with students in an educational setting (schools, tutoring)
• Make backup copies for personal use

This license does NOT permit you to:

• Resell, redistribute, or commercially exploit the generated workbooks
• Remove or alter any copyright notices or watermarks
• Claim authorship of the AI-generated content

5. Payment Terms

5.1 Pricing

All prices are displayed in Indian Rupees (INR) unless otherwise specified. Prices are subject to change without notice, but changes will not affect orders already placed and confirmed.

5.2 Payment Processing

All payments are processed securely through Razorpay. By making a purchase, you agree to Razorpay's terms of service. We accept various payment methods including credit cards, debit cards, UPI, and net banking as supported by Razorpay.

5.3 Taxes

Prices displayed include applicable GST (Goods and Services Tax) as required by Indian law.

5.4 Refunds

Refunds are processed according to our Refund Policy. Please review it carefully before making a purchase.

6. Prohibited Uses

You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service. Prohibited activities include but are not limited to:

• Generating content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Using the Service to generate content that infringes on intellectual property rights
• Attempting to gain unauthorized access to the Service or its related systems
• Using automated systems (bots, scrapers) to access the Service without permission
• Reselling or commercially redistributing generated workbooks without authorization
• Interfering with or disrupting the Service or servers connected to the Service
• Impersonating any person or entity or misrepresenting your affiliation
• Using the Service for any commercial purpose other than as expressly permitted

7. AI-Generated Content Disclaimer

Our Service uses artificial intelligence to generate educational content. While we strive for accuracy and quality, you acknowledge that:

• AI-generated content may occasionally contain errors or inaccuracies
• We recommend reviewing generated content before use, especially for formal educational purposes
• The generated content is intended as practice material and should not be the sole source of education
• We continuously improve our AI systems but cannot guarantee perfection

8. Limitation of Liability

To the maximum extent permitted by applicable law, Tech Udyam Solutions Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you exceed the amount you have paid to us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that the Service will function uninterrupted, secure, or available at any particular time or location, or that any errors or defects will be corrected.

10. Indemnification

You agree to defend, indemnify, and hold harmless Tech Udyam Solutions Private Limited and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Delhi, India, for the resolution of any disputes arising out of or relating to these Terms or the Service.

12. Dispute Resolution

Before filing a claim, you agree to try to resolve any dispute informally by contacting us at support@worqbook.com. We will attempt to resolve the dispute through good faith negotiations within 30 days. If the dispute cannot be resolved informally, you agree that it shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India.

13. Modifications to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and Cookie Policy, constitute the entire agreement between you and Tech Udyam Solutions Private Limited regarding the use of the Service.
